The Terms and Conditions (T&C) outlined below constitutes the basis of our services and the way we work with our clients. CapturedPro Photography has a clear and simple to understand T&C.
It is simple, easy to understand and you must agree to these Terms and Conditions if you wish to work with us.
These Terms and Conditions are considered as “Understood & Agreed Upon” once the booking request is submitted to CapturedPro Photography.
Privacy:
When you wish to work with us, we will require some basic information about you. This information helps us understand you and assists us in providing you tailored services. This information includes but not limited to:
Your Identity:
Your identity includes: Full name, Gender, date of birth, Contact Details (Mobile & Email), your residential address and information about any health condition or cultural/religious sensitivity that you believe CapturedPro Photography must be made aware of.
Why do we require your identity information?
To find out who you’re, how we may contact you and to be aware of any special circumstances as well as provide you the best possible services.
Do we use cookies?
We DO NOT use cookies.
Do we disclose any information to outside parties?
We do not sell, trade, or otherwise transfer to outside parties your personally identifiable information. This does not include trusted third parties who assist us in operating our website, conducting our business, or servicing you, so long as those parties agree to keep this information confidential. We may also release your information when we believe release is appropriate to comply with the law, enforce our site policies, or protect ours or others rights, property, or safety. However, non-personally identifiable visitor information may be provided to other parties for marketing, advertising, or other uses. CapturedPro Photography uses “Order a Print” for its printing purposes for the art work available for purchase on our website under the “Store” page. When ordering a print via “Order a Print”, the information you supply on our website is collected by “Order a Print” and as such, it is not our responsibility to be accountable for the information you provide to “Order a Print”.
Hiring CapturedPro Photography to work for you:
If you hire CapturedPro Photography to work for you, all final processed photographs (usually provided to you via Dropbox or USB) from the photo shoot are your property and may carry CapturedPro Photography's logo. If we wishes to use your photo(s) which shows your face taken by CapturedPro Photography, we will seek your written permission and outline what purpose the photo(s) will be used for. Once the permission is granted, you allow CapturedPro to use the photo(s) for the purpose you have granted the permission. If you change your mind after the grant of the permission, please write to CapturedPro at info@capturedpro.com.au and advise us of your change of decision. Please note that where your face is not visible in the photo(s), we may use the photo(s) without your permission as this does not disclose your identity in anyway unless you advise us in writing not to do so.
NOTE: CapturedPro Photography does not provide RAW images to its clients. We may take more photos than what we provide you as final images. The additional photos are taken in order to ensure we have captured the right moments and able to select the best photo from among the similar photos . We do not provide all photos taken to our clients unless this is agreed between the client and us prior to the photo shoot.
You must seek written consent from CapturedPro Photography if you wish to sell photos or media provided to you by CapturedPro Photography. Such requests are to be assessed and the outcome of assessment to be advised to you in writing. CapturedPro Photography has the right to decline grant of permission for photos or media to be sold to third parties or impose additional charges in order to grant such permission.
Initial Deposit: You must pay an initial deposit (see our booking page for applicable initial deposit for your preferred photo shoot) at the time of submitting your booking request. Bookings cannot be processed without initial deposit with exception to TFP photo shoots.
Once your booking is confirmed, we will issue an invoice which will confirm the initial amount payment and quote the outstanding balance. You will have to make the payment of the outstanding balance before or by the due date indicated in the invoice. An overdue invoice will be subject to 10% additional fee of the total amount if overdue by one week. Additional overdue weeks will be calculated respectively.
Minimum Booking Policy:
Effective 1st December 2019, CapturedPro Photography practices the 3 hours minimum booking policy. This policy applies to all our services offered with exception to passport photos. Unless agreed in writing, we no longer take bookings less than 3 hours in duration.
Cancellation:
If you decide to cancel your photo shoot, you must give us at least 48 hours of advanced notice. Cancellation requests received in less than 48 hours from the time of the photo shoot are not entitled to the “Initial Deposit” amount paid to CapturedPro Photography at the time of booking. Cancellations due to reasons beyond your control are fully refundable. Evidence maybe required for claims of reasons for cancellation beyond your control.
Working for CapturedPro Photography:
If we pay you to work for CapturedPro Photography as an artist (usually referred to as model or character), all content from the photoshoot are our intellectual property. You are not entitled to any of the photos or credit for photos unless we decide to do so. When we pay a client to work for us, we use the photo(s) for commercial, advertising and promotion purposes. Payment for the agreed amount will be made to you on the photo shoot day.
Payment can be made in the form of Cash, Bank Transfer or PayPal. We do not require a payment receipt from you unless we ask you to do so. However, you will be required to sign Photographic Release & Consent Form.
Collaboration also referred to as “Time for Print (TFP):
If we collaborate and work together, all the photographs from the shoot are to be used for portfolio purposes only. The use of photographs for portfolio purposes are automatically granted to both parties and no notice is required before publishing the photographs.
If either you or CapturedPro decide to use the photographs for any purposes other than portfolio, a written consent must be agreed upon between you and CapturedPro Photography.
If you or anyone you nominate intends to use the photographs for commercial purposes, you must seek CapturedPro’s written approval. CapturedPro will decide on an appropriate amount of compensation from you or the person/company you nominate to use your photo(s) commercially.

Date, Time, Location, number of photos & theme for the photo shoot needs to be agreed prior to the photo shoot. We charge a fully refundable $50 (fifty) deposit for all collaborative photo shoots. This deposit is to ensure you attend the photo shoot. The $50 deposit will be given to you in your preferred way of payment on the photo shoot day. If you decide to cancel the photo shoot in less than 48 hours from the time of the photo shoot, you will not be entitled to this deposit.
Types of Photo shoots not practiced and or offered at CapturedPro Photography:
Photo shoots of any nature or type that violets the law of the country in which CapturedPro Photography operates cannot be offered. We also do not offer photography services that promotes: hate, pornography, harassment, racism, insult of an individual or groups believes or religions, violence, or any other similar activities.
Content (media):
Media on our website are our sole intellectual property. Using our content for purposes other than social media sharing without our written permission may end you up at the court. Visitors are welcome to use the share feature available for media and share the available content on their social media.
Some of the photographers on our website are provided by our host www.wix.com and usage of these photographs are subject to Wix's permission. Photographs from wix are samples of work within out capacity to achieve and provide to our clients.
Frequently Asked Questions:
1 – How long does it take to provide your photos from the date of photo shoot?
We usually provide you the agreed number of photos from the photo shoot within 1 week time unless we agree upon a specific time.
2 – How do we provide you the photos?
You may select one of these: 1 Dropbox/Email (free) or 2 USB/CD at an additional cost of $10.
3 – Does our services fee include Goods & Services Tax (GST)?
No - We are freelance photographers and our service fee does not include GST. If you wish to receive a tax invoice, you will be charged an additional amount of applicable tax. Your tax will be declared to the Australian Taxation Office (ATO) by CapturedPro Photography . Please indicate in the booking form if you require a tax invoice or not.
